Choosing a Debt Settlement Company that is Right for You

Working with a debt settlement company is not right for everyone. Debt settlement is designed for consumers who are unable to maintain payments and are considering bankruptcy or credit counseling. With that in mind, there are several things you should consider when choosing who to work with. The Federal Trade Commission (FTC) advises to stay away from companies that claim the following:

  • Promises unsecured debts will be paid off for pennies on the dollar. There is no guarantee that any creditor will accept partial payment of a legitimate debt.
  • Always contact your creditor directly when you experience problems making payments.
  • Tells you to stop making payments to or communicating with your creditors. If you stop making payments on a credit card, additional fees and charges will still be added to your account, even if you have maxed out your card. Don't forget this will negatively affect your credit score as well.
  • Requires monthly service fees and payment of a percentage they have claimed to save you. Most debt relief companies charge several fees to get started and to carry on with their services.
  • Claims that they can remove accurate negative information from your credit report. No company or person can remove this information –it's illegal.
  • Claims that creditors won't sue people for not paying their unsecured debts. Creditors have the right to sue you, and if they win, they have the right to garnish your wages or put a lien on your home.
